Terms and Conditions for our Rentals

By booking a rental item on our website you are entering a legally binding contract between yourself and Mother Nurture Clothing and Apparel.

Title to rental items

The rental items will at all times remain the property of Mother Nurture Clothing and Apparel. We reserve the right to retrieve the item/s at anytime if deemed necessary.

Use and damage of Clothing and late returns

We expect that our clothing with be treated with the highest standard of care. You may not temporarily or permanently alter the clothing in any manner. You must return the rental clothing on the 4th day of the booking period unless otherwise agreed. The rental clothing must be returned in the same condition as you received it.

When you receive your rental clothing it is your responsibility to to inspect the rental clothing and to notify us upon receipt if there is any damage, defect or other issue with the item/s. We recommend that this is done as soon as possible and within 4 hours of receiving your item/s.

If the rental item arrives back in our possession and we determine that the item can not be fixed or needs to be repaired we have the right to charge you a replacement fee which is usually to the amount of the recommended retail price (RRP) of the item. We also have the right to charge you a replacement fee if a rental item is not returned.

If a rental item is not returned within the booking period we have the right to charge you a Late fee. If we need to charge a late or replacement fee we have the right to charge you an administration fee. This charge involves costs related to following up with you on late delivery or lost clothing, bank fees, the time and cost of manufacturing a new item (this list is not exhaustive of all the costs involved).

You authorize Mother Nurture Clothing to debit your card that was used to make the booking fee if replacement fees, late fees, or administration fees apply. Any of these fees which are paid by you are additional to your booking fee.

If you fail to return the clothing and have subsequently paid replacement fees, late fees and/or administration fees you will then have “purchased” the clothing we make no warranty to you in respect of that clothing item/s.

Availability of Clothing

Sometimes rental items may not be available. There may be situations out of our control and the item may at short notice not be available anymore. This may occur when a previous customer has not returned a rental item or it has been damaged.

We have built a safety net into our calendar booking for cases such as this and we will try to manufacture a rental item to replace the damaged or lost rental item as soon as reasonably possible but we make no guarantees. Our customers satisfaction is top of mind and we endeavor to do that at all times.

If we are not able to replace the rental item in time for your event we endeavor to give you as much notice as we are able to depending on the individual circumstances. This will allow you to hopefully make alternative arrangements  for your event and we will refund you your booking fee and delivery fee if already paid in full.

Booking period of a rental item 

Our standard rental period for one day special events is for 4 days. It is suggested that you book the dress to be delivered 2 days before your event. So your event would then be the 3rd day of the booking period in terms of our calendar booking. The dress is then returned the day after your event (which in terms of our calendar booking is the 4th day of the booking period).

Payment of a booking fee

By placing a booking on our online store and selecting your payment method of choice you agree to the terms outlined in this agreement. You guarantee that you are authorised to use the method of payment selected and your credit/debit card is yours. You agree that you will not dispute the payment with your provider if Mother Nurture Clothing and Apparel fulfils your booking and provides you with your rental item/s that you have booked.

You authorise Mother Nurture Clothing and Apparel to charge your supplied payment method for any additional fees as mentioned in this agreement (i.e. late fees, replacement fees and administration fees). If we can not charge the supplied payment method we will issue an invoice for these fees which you agree to pay within 5 working days.

If your payment for the booking is reversed or rejected for some reason, you agree to pay the outstanding amount within 48 hours. If you fail to make payment within 48 hours we will cancel your booking. If we have already sent out your rental items you will still be liable for the full book fee.

We have a REFUNDABLE RENTAL DEPOSIT built into our pricing of our rental items of R250 to cover the possibility of damages to a rental item. But if damages amount to more than the refundable rental deposit amount you will be liable to cover these costs.

Mother Nurture Clothing and Apparel reserves the right to take all necessary actions to recoup the amounts that are owed to us as determined by this agreement. We resort to taking legal action if deemed necessary and may make use of debt collection agencies if need be. If this is the case this will increase the amounts owed to us as need of these services will be billed to you.

Extending a booking period

If there are specific circumstances and you will need a longer rental period please either speak to our chat support online or send us an email.

Cancelling a booking 

If your event is cancelled and you will require to cancel your booking fee we are able to cancel a booking if done within 10 days prior to your booking as we start to prepare the dress well in advance and send out the dress in a timely fashion. We will refund you your booking fee but we will charge you a cancellation fee of R50 in order to process banking fees related to you cancelling your booking. 

If you cancel your booking 9 days prior to your booking we will unfortunately not be able to refund you. If we have not sent out your rental item/items we can issue a gift voucher to the amount of your rental fee which you can use in the future. If your rental item/s have been shipped already we will unfortunately not be able to cancel your booking. We do understand that unforeseen circumstances occur and events are cancelled or moved. We will try our best to help customers wherever possible and to accommodate you if we can.

We may have to cancel a booking if a few of the following scenarios occur:

  1. If a previous customer returns your rental item and it is damaged and we won’t have enough time to repair the item. We will try our utmost best to repair the item in time for your event but we may need to cancel your booking if we are unable to repair it in time, we will offer a style consult if you would like to book another dress that is suitable and available or we will refund you your booking fee but our customers satisfaction are of our utmost importance so we will try to assist you so you have something to wear for your event.
  2. If a previous customer returns your rental item and it is damaged beyond repair and we aren’t able to make a replacement item in time. As above we will try our utmost best to manufacture a new one in time for your event. We need to source fabric and materials in time and dependent on our load of other items being manufactured etc. As mentioned above we will either help you choose another dress that is suitable and available or we will at worst case scenario we will refund you  your booking fee.
  3. If a previous customer fails to return your rental item at all or in time for your booking. If we do not have enough time to manufacture a new rental item for you. As above we will try our utmost best to get you the rental item you booked either by retrieving the dress from the previous customer, manufacturing a new dress or assisting you in selecting a new dress that is suitable and available. As above our worst case scenario will be that we will need to refund you your booking fee but we will endeavour to help you find something suitable to your event.

Shipping of our rental items or collection of our rental items at our local collection point:

The rental dress will be delivered to your door if you selected door to door delivery 2 days before your event.

Alternatively, if you selected to pick up the rental dress from our local pick up point then we will send you an email to arrange when you can collect the dress.

NB: When selecting your booking date please be sure to select the date the dress needs to arrive at you and not your actual event date.

A booking period is for 4 days. An explanation of the booking period in a bit more detail explains why it is a 4 day period that is booked for a one day special event rental dress. The dress arrives 2 days before your event in case of any issues with delivery. On the 3rd day of your booking is when you event will be and the 4th day is the day you need to return your dress.

Our booking calendar is organised to factor in inspection, cleaning and repairs of dresses. Please check when a dress is available. The booking calendar will only let you book a dress if it is available.

If your delivery of your rental item/s does not happen on time because you provided the incorrect delivery details such as the incorrect  delivery address, we will not be held liable for your item not arriving in time for your event. We have suggested that the booking period be organised for 2 days before the event to allow for errors in delivery but if the delivery of an item is not possible and additional delivery charges are incurred due to incorrect information being provided you will be liable to pay these additional charges. If your rental item/s do not arrive in time for your event due to this we will not be healed liable and you will not be entitled to a refund or credit. It is your responsibility to ensure all delivery details are correct and that the person accepting the delivery is available at the time the courier delivers your item/s.

If you collect the item/s from our local pick up point once you the item/s leave our premises you are responsible for the item/s. Mother Nurture Clothing and Apparel will not be held liable for any loss, theft or damage once the item/s have been collected from our pick up point. 

Return delivery of our rental items or return of our rental items at our local drop off point:

The rental dress will be collected from your given address the day after your event. This will be the same address given for the delivery of the dress unless otherwise communicated to us and arrangements have been made.

Please package the dress into the required garment bag for safe delivery of the dress. The courier company will provide a shipper bag upon collection.

If you will be dropping off the dress at our local drop off point you will be required to drop off the dress the day after your event. We will send you communication and you can select what time you would like to drop off the dress.

Exchange of rental items if it is the wrong fit/size

Exchanges may be possible. Please send us an email as soon as you receive the rental dress and you see that it does not fit. We do recommend that you visit our sizing guide and choose your dress size based off of the sizing guide which should prevent any dresses from not being the correct fit. If there is an issue with the fit we will try to send you the rental dress in a different size provided there is sufficient time to send it to you. We will try our best to assist you so you have the dress for your event but this is dependent on where you are located as areas outside of main centres may have longer delivery times and may not reach you in time.

It is vitally important if you are outside of a main centre and delivery times are longer that you CHECK our SIZING GUIDE and if you are uncertain to get in contact with us so we can best advise you on the size selection so we do not have an issue with fit.

If it is within your budget it might be wise if you are outside of a main centre and haven’t been able to check your measurements to book two dresses in the same style in two different sizes. When the dresses arrive try them on. Wear the dress that fits and we can give you a gift voucher to the value of the booking fee to use for the dress that didn’t fit. You then return the two dresses at the end of the booking period together. We will inspect both dresses and send you the gift voucher to the value of the booking fee for the dress you didn’t wear and we will return your refundable deposit on the dress you did wear.  

Events out of our control

Certain events are out of our control. These may include but are not limited to these situations listed here. In the event of a natural disaster which prevents us from rendering our rental service to you such as flooding, earth quakes etc. In the event of civil war or other situations where there is unrest and delivery services are impacted. 

Return of you REFUNDABLE Deposit

We will return your deposit through our secure payment gateway Yoco. Once your rental item has been returned we will inspect the item and send it for cleaning. If it is determined  that the item was returned in the condition it was received your deposit will be refunded. It may take 10 working days to receive your deposit through our secure payment gateway Yoco.
